Terms of Use

These terms are an agreement between you and Anton Mitrafanau, IE (“we”), who provides Planty. By using the app you accept them. Your license to the app itself is governed by Apple’s Standard End User License Agreement; these terms add to it for the service the app connects to.
In short
- Identifications, care guides and assessments are produced automatically, partly by AI. They can be wrong, so check anything important.
- Never rely on Planty to decide whether a plant is safe to eat, or safe around children or pets.
- Use it lawfully, and don’t try to get around its limits.
- Premium renews automatically through Apple until you cancel it.
1What Planty is
Planty identifies plants from photos using Kindwise’s Plant.id service, writes care guides and, with Premium, suggests what to check when a plant changes, using AI models provided by OpenAI. All of it is generated automatically and can be wrong, incomplete or out of date. Care advice is general: your plant, its conditions and your climate matter more than any schedule. An assessment suggests possible causes and next steps; it is not a diagnosis.
2Safety
Information about whether a plant is toxic may be missing or wrong. Planty shows one of three answers, toxic, non-toxic or unknown, and says where each comes from: a reviewed reference such as NC State Extension’s Plant Toolbox, or AI, marked as not verified. Unknown never means safe.
Never rely on Planty to decide whether a plant is safe to eat or touch, or to keep near children or pets, and do not use it to choose wild plants or mushrooms to eat. If someone may have swallowed part of a plant, contact a doctor, a poison control center or a veterinarian at once. Planty is not medical, veterinary or other professional advice.
3Who can use it
You must be at least 13. If you are under the age of majority where you live, use Planty with the permission of a parent or guardian.
4Using it fairly
Do not use Planty to:
- break the law, or infringe anyone’s rights;
- send photos of people, or of anything you have no right to share;
- get around the free allowance, the subscription check or usage limits;
- reach the service other than through the app, including by scripts or bots, or take the app apart to do so;
- overload or disrupt the service.
OpenAI’s usage policies also apply to what you send for an assessment.
5Your photos and notes
Your photos and notes remain yours. You allow us to process them, and to pass them to Kindwise and OpenAI, only to provide the service, as the Privacy Policy describes. You are responsible for how you use what Planty tells you.
6Free use and Planty Premium
Without a subscription, Planty includes one plant in your garden, three photo identifications in all, and two care guides from search a day; the first guides are shown in full, later ones in part. Planty Premium unlocks unlimited identification, full care guides, plant assessments and more plants in your garden.
- Premium is an auto-renewable subscription, weekly, monthly or yearly, sold by Apple at the price shown in the app before you buy.
- Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for the same period and price unless you cancel it at least 24 hours before the current period ends.
- If a free trial is offered, the subscription starts at its end unless you cancel at least 24 hours before. Any unused part of a trial ends when you buy a subscription.
- You can manage or cancel the subscription in your Apple Account settings. Canceling stops the next renewal; the current period runs until it ends.
- Refunds are handled by Apple, under Apple’s policies.
- When Premium ends, your garden keeps its first plant. The others, and their reminders, stay on your device, paused until you subscribe again.
“Unlimited” means we do not count identifications or guides. To keep the service working for everyone, unusually heavy use can be paused for up to 24 hours.
7Changes to the service
We may change, add or remove features, the providers and the AI models behind them, and may stop offering the service. We will try to give notice of significant changes.
8Privacy
How we handle your data is set out in the Privacy Policy.
9No warranty
The service is provided “as is” and “as available”. To the extent the law allows, we make no promises about the accuracy, reliability or availability of the service or what it tells you, and do not guarantee that it will be uninterrupted or free of errors.
10Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss arising from relying on an identification, a guide or an assessment, including harm to plants, people or animals. Nothing in these terms limits liability that the law does not allow to be limited, or takes away your rights as a consumer.
11Suspension
We may suspend or end access for anyone who breaks these terms or abuses the service.
12Apple
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing claims relating to it. If the app fails to conform to a warranty that applies to it, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13Law
These terms are governed by the laws of the country where you live, and do not take away any rights you have under them.
14Changes to these terms
We may update these terms. The new version is published here with a new date; using the app after it takes effect means you accept it.
